By creating an account, clicking "I agree," or using the Portal, you accept these Terms, our
Privacy Policy and any other policies referenced here. If you do not agree, do not use the Portal.
You must be at least 18 years of age, capable of entering a binding contract, and authorized to use the bank account or card you provide. You agree to keep your contact, unit, and payment information accurate and current and to maintain the security of your credentials. You are responsible for all activity under your account.
(a) Cards. You may pay with a credit or debit card (subject to card‑network rules). By submitting a payment, you authorize the card issuer to charge your card for the amount shown, plus a 2.9% convenience fee disclosed at checkout.
(b) ACH/eCheck. By entering your bank information and confirming a debit, you provide an ACH authorization to us, Finix, and their banking partners to initiate debit entries from your account for the amount shown and to initiate credit entries for refunds, adjustments, or error corrections. This authorization remains in effect for one‑time payments or, if you enable AutoPay, until you cancel as described below.
(c) Fees & Surcharges. The Association may choose to pass through processing fees (e.g., card convenience fees) or offer no‑fee ACH. Any fee will be displayed before you confirm payment. Note: Card surcharging is regulated and may be prohibited or limited in some jurisdictions; your Association's policy applies. For Washington users, debit card surcharges are not permitted.
(d) Timing & Settlement. A payment is submitted when you confirm it in the Portal. A payment is received by the Association when it successfully settles and is not returned or charged back. Displayed posting dates in the Portal are estimates only.
(e) Bank & Network Rules. You agree to comply with applicable rules and laws, including the NACHA Operating Rules for ACH and card‑network rules for card payments.
You may opt into AutoPay to have recurring assessments charged automatically. By enabling AutoPay, you:
Payments made through the Portal are payments to your Association. Any refund, waiver, or adjustment is governed by the Association's policy and governing documents. Dynamite does not decide or issue refunds; we facilitate the transaction flow.
Disclaimer: Dynamite Management LLC and HOA Fiscal do not have authority over Association refund decisions. All refund requests must be directed to your Association's designated contact. Approved refunds will be issued by the original method of payment when feasible.
After submission, you'll see a confirmation screen and/or email receipt to the address on file. Your Portal dashboard shows recent activity; however, your official account status is maintained by your Association's ledger. Keep your contact info current so you receive notices.
To protect users and comply with law, we and Finix may (without notice) delay, decline, reverse, or place holds on payments; require additional verification; or restrict features if fraud, error, prohibited activity, or legal non‑compliance is suspected (e.g., OFAC sanctions, AML flags).
You may not use the Portal to: (a) pay for unlawful purposes; (b) misrepresent identity, unit, or authorization; (c) interfere with Platform security; (d) circumvent fees; (e) test stolen or unauthorized cards/accounts; or (f) engage in any activity prohibited by our processor, card networks, NACHA, or applicable law.
By using the Portal, you consent to receive electronic communications (e.g., receipts, disclosures, notices) via the Portal, email, SMS, and in‑app messages. You agree that electronic signatures and confirmations in the Portal have the same legal effect as handwritten signatures. You may withdraw e‑consent by contacting us at support@hoafiscal.com; doing so may limit your ability to use the Portal.
We collect and use personal information as described in our Privacy Policy. We do not display your full card or bank account numbers in the Portal. Payments are processed by Finix and its bank partners; we share only the information necessary to process transactions, provide support, and meet legal obligations.
The Portal may be unavailable due to scheduled maintenance, outages, or factors outside our control (e.g., bank/network downtime). We are not liable for delays caused by third‑party services, networks, or your devices/internet connection.
HOA Fiscal™, logos, and related marks are trademarks of Dynamite Management LLC. The Platform, including text, software, and interfaces, is owned by or licensed to Dynamite and is protected by IP laws. We grant you a limited, revocable, non‑exclusive license to use the Portal solely to pay your Association.
THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR‑FREE OPERATION.
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER DYNAMITE NOR ITS AFFILIATES, PROCESSORS, OR SUPPLIERS ARE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, REVENUE, OR DATA; OR FOR AMOUNTS IN EXCESS OF THE FEES (IF ANY) YOU PAID US FOR THE RELEVANT TRANSACTION IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Dynamite, the Association, Finix, and their respective officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) your misuse of the Portal; (c) disputes over assessments/fees with the Association; or (d) your violation of law or third‑party rights.
We may suspend or terminate your access to the Portal at any time, with or without notice, for any reason, including suspected fraud or violations of these Terms. You may stop using the Portal at any time. Sections intended to survive (including payment authorizations for transactions already submitted, refunds, IP, disclaimers, limitations, indemnities, and governing law) will survive termination.
We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by posting in the Portal, email, or in‑app message). Your continued use after the effective date constitutes acceptance of the updated Terms.
Governing Law. These Terms are governed by the laws of the State of Washington, without regard to its conflicts‑of‑law rules.
Venue. You consent to exclusive jurisdiction and venue in the state or federal courts located in Clark County, Washington for claims that are not subject to arbitration.
At either party's election, any dispute arising out of or relating to these Terms or the Portal shall be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules. You and we waive any right to a jury trial or to participate in a class action. This clause does not apply to claims that cannot be arbitrated as a matter of law or to equitable relief to protect IP or platform security. The seat and venue of arbitration shall be Clark County, Washington. The arbitrator may award individual relief only.
By clicking Pay (for one‑time) or Enable AutoPay (for recurring), you agree:
ACH Debit Authorization. I authorize Dynamite Management LLC, its payment processor Finix Payments, Inc., and their bank partners to initiate electronic debit entries from the bank account I specify, and to initiate credit entries to the same account to correct errors or issue refunds. For AutoPay, I authorize recurring debits in the amounts and on the schedule shown in my settings until I cancel as provided in these Terms. I am an authorized signer on the account. I may revoke this authorization by turning off AutoPay or contacting support; I understand changes must be made at least three (3) business days before the next scheduled debit to avoid it. I will promptly notify my bank and the Association of any unauthorized debit. This authorization is subject to applicable law and the NACHA Operating Rules.
These Terms, together with the Privacy Policy and any payment disclosures shown at checkout, form the entire agreement between you and us regarding the Portal. If any provision is found unenforceable, the remainder will remain in effect. Our failure to enforce a provision is not a waiver.
